1. Acceptance of Terms

By downloading, installing, or using the ChibyooShell iOS application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Chibyoo ("the Developer", "we", "our", or "us").

2. Description of the App

ChibyooShell is a professional iOS application that provides:

• SSH terminal access to remote servers
• SFTP file management
• Real-time server monitoring (CPU, RAM, disk, network)
• Docker and Podman container management
• SSH port forwarding
• SSH key generation and management

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that:

1. You are at least 13 years of age
2. You have the legal authority to agree to these Terms
3. You will use the App in compliance with all applicable laws and regulations

4. License

4.1 Grant of License

Subject to your compliance with these Terms, Chibyoo grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, solely for your personal or internal business purposes.

4.2 Restrictions

You may not:

1. Copy, modify, or distribute the App or any portion thereof
2. Reverse engineer, decompile, or disassemble the App
3. Remove or alter any proprietary notices or labels on the App
4. Use the App to build a competitive product or service
5. Sublicense, sell, resell, transfer, or assign the App
6. Use the App in any manner that could damage, disable, or impair the App or our servers

5. Acceptable Use

5.1 Permitted Use

You may use the App to connect to and manage servers for which you have explicit authorization.

5.2 Prohibited Use

You must not use the App to:

1. Access, monitor, or manage any computer system or server without explicit written authorization from the system owner
2. Conduct or facilitate unauthorized access, hacking, or any form of cyberattack
3. Intercept, monitor, or capture data transmitted by others without authorization
4. Violate any applicable local, national, or international law or regulation
5. Infringe upon the intellectual property rights of any party
6. Transmit malware, viruses, or other malicious code
7. Engage in any activity that disrupts or interferes with third-party services or networks

You are solely responsible for ensuring you have proper authorization for all systems you connect to using the App.

6. User Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at:

7. Third-Party Services

The App integrates with third-party services including Firebase (Google) for analytics and crash reporting, and Apple's iCloud for optional data synchronization. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.

8. Intellectual Property

8.1 Our Property

The App, including all content, features, and functionality, is owned by Chibyoo and is protected by international copyright, trademark, and other intellectual property laws.

8.2 Feedback

If you provide us with feedback, suggestions, or ideas about the App ("Feedback"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and incorporate such Feedback into our products and services without any obligation to you.

9. Disclaimers

9.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee of Availability

We do not guarantee that the App will be available at all times, error-free, or free from interruptions. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

9.3 Security

While we implement reasonable security measures, no method of electronic storage or transmission is 100% secure. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your use of the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHIBYOO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

1. Loss of data, revenue, or profits
2. Unauthorized access to or alteration of your transmissions or data
3. Damage to your servers, systems, or data resulting from use of the App
4. Any other matter relating to the App

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Chibyoo and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

1. Your use of the App in violation of these Terms
2. Your violation of any third-party rights, including intellectual property or privacy rights
3. Any unauthorized access to systems facilitated by your use of the App
4. Your violation of any applicable law or regulation

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or the applicable courts of competent jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your license to use the App will immediately cease.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chibyoo regarding the App and supersede all prior agreements and understandings.
